These Terms of Service ("Terms") govern your use of Cardex (the "App"), a trading card scanner, pricing and collection management application, together with any related websites and services we provide. Please read them carefully.
By downloading, installing, accessing or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may only use the App with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
We may update these Terms from time to time. Material changes will be posted at this URL with a revised "Last updated" date. Continuing to use the App after changes take effect means you accept the revised Terms.
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App for managing, valuing and showcasing your own trading card collection, including commercial use by card vendors within the App's intended features.
You agree not to:
You retain ownership of the content you create in the App, including your collections, card photos, notes and showcase binders. By publishing a showcase you generate a public link and grant us a limited licence to host, reproduce and display that content for the purpose of serving it to people who open your link.
You are solely responsible for the accuracy of the prices, descriptions, availability and any representations you publish in a showcase, and for any transaction you enter into with another person. Cardex is not a marketplace, payment processor, escrow service or party to any sale between you and a buyer.
Some features require an account. You are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly at the address below if you believe your account has been compromised. You may use certain features without an account, with reduced functionality.
The App offers optional paid subscriptions ("Cardex Pro") that unlock features such as higher scan allowances, multi-card scanning, advanced pricing tools and expanded showcase capabilities. Free features remain available without payment.

We do not warrant that catalogue data, images, availability or prices are accurate, complete, current or fit for any particular purpose.
The App, including its software, design, user interface, trained models, database structure and branding, is owned by Cardex and its licensors and is protected by intellectual-property laws. Except for the licence in section 2, no rights are granted to you.
Trading card names, images, set symbols, logos and other card content are the property of their respective rights holders. Cardex is an independent tool and is not affiliated with, endorsed, sponsored or approved by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., Bandai, Toei Animation, Wizards of the Coast, TCGPlayer, PriceCharting or any other publisher or rights holder. Card content is used for identification and reference purposes only.
If you believe content in the App infringes your rights, contact us at the address below with enough detail to identify the material and we will review it promptly.
The App relies on third-party services, including Google Firebase (authentication, analytics, crash reporting, notifications), Google Play Billing and RevenueCat (subscriptions), the Google Gemini API (AI-assisted recognition and voice transcription), and TCGPlayer and PriceCharting (pricing and catalogue data). Your use of those features is also subject to the relevant third party's terms, and we are not responsible for their services, availability, content or acts and omissions. Third-party links in the App are provided for convenience only.
We may add, change, suspend, limit or discontinue features at any time, and we may impose or adjust usage limits. We aim for reliable service but do not guarantee uninterrupted or error-free availability, and maintenance, outages or third-party failures may cause downtime or data-refresh delays. You are responsible for keeping your own backups of data that matters to you.
You may stop using the App at any time and can delete your account and server-side data from Settings > Delete Account.
We may suspend or terminate your access, with or without notice, if you breach these Terms, if your use creates a security, legal or operational risk, if required by law or by a third-party provider, or if we discontinue the App. Where reasonably practicable and lawful, we will give you notice.
On termination, your licence ends immediately and locally stored data may become inaccessible. Sections that by their nature should survive termination (including sections 5, 6, 10, 11 and 12) continue to apply.
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will meet your requirements, that identification or pricing will be accurate, or that defects will be corrected.
Nothing in these Terms excludes or limits any right or guarantee you have under applicable consumer-protection law, including the South African Consumer Protection Act, that cannot lawfully be excluded or limited.
To the maximum extent permitted by law, Cardex and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, business opportunity, sales, or data, arising out of or relating to your use of the App — including losses arising from misidentified cards, inaccurate or delayed pricing, a sale or purchase you made in reliance on the App, or unavailability of the service.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App is limited to the greater of (a) the amount you paid us for the App in the twelve months before the event giving rise to the claim, or (b) ZAR 500.
These limits apply even if a remedy fails of its essential purpose, and to the extent they are held unenforceable, the remaining provisions continue to apply.
You agree to indemnify and hold Cardex harmless from claims, damages, liabilities and reasonable costs arising from your breach of these Terms, your published showcase content, or any transaction between you and another person.
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-laws rules. You and Cardex submit to the non-exclusive jurisdiction of the courts of the Western Cape, South Africa. Nothing prevents you from bringing a claim in your local courts where applicable law gives you that right.
Before starting formal proceedings, please contact us so we can try to resolve the matter informally.
These Terms, together with the Privacy Policy, are the entire agreement between you and Cardex regarding the App. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
